Bohler’s James Thaon Talks REAL Stormwater Rules with NJBIZ

07 November, 2024

New Jersey’s proposed Resilient Environments and Landscapes (REAL) reforms are designed to address environmental challenges like sea-level rise, flooding, and stormwater management. These changes are expected to impact development requirements, including higher first-floor elevations and stricter stormwater management standards. Experts, including Bohler partner and Red Bank Branch Manager James Thaon, are urging developers to prepare proactively, as these rules will add costs and alter design strategies.

In this recent NJBIZ article, James offered insights into how Bohler is helping clients navigate these impending regulations. He emphasized that while the new rules present challenges, Bohler’s approach is pragmatic and solution-focused. His team continues to be proactive in raising awareness through blogs, emails, and client meetings, which have fostered productive discussions about the impact of REAL on site selection and project timelines. James highlighted the need for strategic planning, particularly for projects with long lead times, advising clients to consider whether their designs should comply with future regulations or current ones.

James also pointed out that the proposed regulations are not entirely new, comparing them to previous green infrastructure and flood protection updates. However, REAL’s elevation changes and floodproofing requirements have broader implications, especially for properties now under NJDEP’s expanded jurisdiction. He emphasized the importance of early engagement, stressing that design adjustments required by the new rules could significantly impact project feasibility, costs, and timelines, especially for sites with existing infrastructure.
